1. Acceptance of Quote

By accepting this quote, you (the "Customer") agree to abide by the terms and conditions outlined herein. This quote is valid for 30 days from the date issued, unless otherwise stated in writing.

2. Scope of Work

The work to be performed will be as described in the provided quote. Any changes or additions to the scope of work requested by the Customer after acceptance will be subject to a new agreement and possible additional charges.

3. Safety Switch Installation

When installing safety switches, it's important to note that pre-existing faults in the electrical system may be detected, leading to safety switch tripping. The client acknowledges that such issues might arise and that necessary corrective measurements may need to be taken. Extra charges will apply for fault finding on pre-existing faults that are found.

4. Payment Terms

  • Quoted Price: The price outlined in the quote is based on the agreed scope of work. Additional costs may apply for any changes or unforeseen circumstances during the project.
  • Final Payment: The balance of the quoted price is due upon completion of the work, unless otherwise agreed in writing. Payment must be made within 7 days of the invoice date.

5. Cancellation Policy

  • The Customer may cancel or reschedule the work with 48 hours notice. Cancellations made within 48 hours of the scheduled start date may incur a cancellation fee.
  • Any work that has already begun or materials ordered will be billed in full.

6. Asbestos Presence

  • The Customer is responsible for informing WestGrid Electrical Pty Ltd if asbestos or any other hazardous materials are present in the areas where work is to be carried out.
  • If asbestos is found during the work, the project will be paused, and a new plan of action, including any necessary safety protocols or specialist removal, will be discussed. Any additional costs due to the presence of hazardous materials will be borne by the Customer.

7. Permits and Approvals

  • The Customer is responsible for obtaining any necessary permits or approvals required by local authorities for the work to be performed, unless otherwise agreed.
  • WestGrid Electrical Pty Ltd can assist with permit applications, and any related costs will be billed separately to the Customer.

8. Access to Premises

  • The Customer must provide clear, safe access to the premises where the work is to be performed. Any obstructions, locked areas, or special access requirements should be communicated prior to the start of the project.
  • Delays due to lack of access may result in additional charges.

9. Warranty

  • The work provided is covered by a lifetime warranty. This warranty covers defects in workmanship but does not apply to damage caused by misuse, accidents, or external factors.
  • Any manufacturer warranties on materials used will be passed on to the Customer.

10. Force Majeure

  • Neither party will be held liable for failure to perform obligations under these terms due to causes beyond their reasonable control, including but not limited to acts of God, natural disasters, pandemics, strikes, government actions, or other unforeseen events.

11. Liability

  • WestGrid Electrical Pty Ltd will take reasonable care to avoid damage to the Customer's property during the course of the work. However, is not responsible for any accidental damage, unless caused by negligence or breach of duty.
  • The Customer is responsible for ensuring the work area is clear of personal property or valuables prior to commencement.

12. Indemnification

  • The Customer agrees to indemnify and hold harmless, its employees, agents, and subcontractors from any claims, losses, or damages arising from the Customer’s failure to disclose hazardous materials (such as asbestos), failure to provide access, or failure to obtain necessary permits.

13. Dispute Resolution

  • In the event of a dispute between the parties, both parties agree to first attempt to resolve the issue through informal negotiation. If the matter cannot be resolved through negotiation, either party may request mediation. If mediation is unsuccessful, the dispute will be resolved by arbitration in accordance with the laws of Australia, WA.
